These Terms of Service (“Terms”) are an agreement between you and You Wish Games LLC, an Oregon limited liability company, and apply when you use youwishgames.com (the “Site”) or place an order. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy.
Orders and Payment
An order is an offer to buy and is accepted when we confirm it and take payment. Prices, shipping, and applicable taxes are shown at checkout. If we discover an error in pricing or availability, we may cancel the affected order and refund you in full. If your order arrives damaged, defective, or incorrect, reach us through our contact form within 30 days of delivery for a replacement or refund.
Our Content
The You Wish! name, logo, card artwork, game rules, and all other content on the Site belong to You Wish Games LLC or its licensors and may not be copied or used commercially without our written permission. You agree not to misuse the Site, interfere with its operation, or use it for anything unlawful.
Disclaimers
The Site is provided “as is.” To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, and our total liability for any claim relating to the Site or an order is limited to the amount you paid us for the order giving rise to the claim. Nothing in these Terms limits rights you have under applicable law that cannot be waived.
Dispute Resolution & Arbitration
If you have a concern, reach us through our contact form and we’ll try to resolve it informally. If a dispute isn’t resolved within 60 days of written notice, then except for small-claims court cases, any dispute arising out of these Terms, the Site, or an order will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules.
You and we each waive the right to a jury trial and to participate in a class action or other representative proceeding. Disputes will be arbitrated on an individual basis only. You may opt out of this arbitration agreement by emailing info@youwishgames.com within 30 days of first accepting these Terms.
Governing Law
These Terms, and any dispute arising out of the Site or an order, are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Any court proceedings not subject to arbitration will take place in the state or federal courts located in Lane County, Oregon.
